OC Concrete Polishing and Epoxy Flooring
Residential Properties:
Our floor coating materials (for areas up to 5000 square feet) are covered by this limited lifetime warranty for the original consumer purchaser as follows:
1) Protection against peeling or delamination from the concrete for as long as the original consumer purchaser owns the home where the floor coating materials were installed.
2) Safeguarding against staining resulting from incidental spills of oil, transmission fluid, radiator fluid, gasoline, and diesel, provided they are promptly cleaned up (within 20 minutes of a spill) for a period of ten (10) years from the date of substantial completion of the OC Concrete work.
Commercial/Industrial Structures:
For floor coating materials installed in commercial, industrial, or business-use buildings (up to a maximum of 5000 square feet), the limited warranty extends for three (3) years from the date of substantial completion of OC Concrete’s work. It covers:
– Protection against peeling or delamination from the concrete.
– Safeguarding against staining resulting from incidental spills of oil, transmission fluid, radiator fluid, gasoline, and diesel, provided they are promptly removed (wiped up within 20 minutes of a spill).
Exterior Surfaces:
For floor coating materials (up to a maximum of 5000 square feet) applied to exterior surfaces, the limited warranty extends for three (3) years from the date of substantial completion of OC Concrete’s work. It covers:
– Protection against peeling or delamination from the concrete.
– Safeguarding against staining resulting from incidental spills of oil, transmission fluid, radiator fluid, gasoline, and diesel, provided they are promptly removed (wiped up within 20 minutes of a spill).
Exclusions:
This Limited Warranty does not apply to, and OC Concrete will not be responsible for, normal wear and tear, or any damage to floor coatings or other property caused by improper repairs made or attempted by anyone other than OC Concrete, faulty maintenance, misuse, abuse, neglect, extreme temperatures, staining or peeling caused by cracking of the substrate, defective substrate, hydrostatic pressure, or moisture vapor transmission levels exceeding eight (8) lbs., battery acid, brake fluid, or other industrial fluids, or as a result of any accident, casualty, or natural disasters.
Please note that this limited warranty is non-transferable and applies solely to the property owner at the time of contracting. Warranty repairs do not extend the original warranty period for the initial installation or any specific component or part thereof.
For floor coatings applied to residential garages, exterior surfaces, commercial/industrial buildings, and all cabinets, OC Concrete will also provide labor for garage floor coating at no cost for a period of one (1) year from the date of substantial completion of OC Concrete’s work. OC Concrete’s sole responsibility shall be the repair or reinstallation, at OC Concrete’s discretion, of any defective floor area or cabinet. OC Concrete’s responsibility is limited to the cost of materials and labor, as specified within the specified timeframes.
Exclusions: This Limited Warranty does not apply to, and OC Concrete will not be liable for, normal wear and tear, or any damage to cabinets or other property resulting from cabinet movement or improper repair attempts by anyone other than OC Concrete, neglect, misuse, abuse, extreme temperature exposure, fire, water, other liquids, or any accident, casualty, or natural disasters. This limited warranty does not cover damage caused by UV exposure, fading, dampness, overloading, water spray, or flooding. Replacement parts will be provided in the closest available color at the time of the warranty claim, recognizing that colors may become discontinued, and existing colors may naturally fade over time, potentially resulting in differences in color or tone between the replacement part and the existing cabinet (this may cause the replacement part to not match the existing cabinet color).
Purchaser’s Exclusive Remedy and Limitation on Liability: The aforementioned Limited Labor Warranty shall be the consumer purchaser’s exclusive and sole remedy against OC Concrete, whether based on a contract, statutory provisions (including those relating to the quality or fitness of the goods supplied under the sales contract), warranty, tort, strict liability, or any other legal theory.
THIS EXPRESS LIMITED WARRANTY IS THE ONLY WARRANTY GIVEN BY OC CONCRETE WITH RESPECT TO THE SERVICES, PRODUCTS, AND MATERIALS PROVIDED UNDER THIS CONTRACT. OC CONCRETE MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, AND HEREBY SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, WHETHER STATUTORY OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
OC CONCRETE’s liability to consumer purchaser on any claim for loss or damage arising out of, connected with, or resulting from the contract of sale, or the performance or breach thereof, or from the design, manufacture, sale, delivery, installation, service, repair or use of the cabinets or floor coatings provided hereunder shall not exceed the price to consumer purchaser of repair or replacement of the defective part or component. In no event shall OC Concrete be liable for special or consequential damages including, but not limited to, injuries to persons or damage to property, loss of profits or anticipated profits, or loss of use of any property.
This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Some states do not allow the exclusion of limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
